Peanut butter is made from peanuts, tomato paste is made from tomatoes, and guacamole is made from avocados, right?

Wrong. The guacamole sold by Kraft Foods Inc., one of the best-selling avocado dips in the nation, calls for modified food starch, hefty amounts of coconut and soybean oils and a dose of food coloring. The dip contains precious little avocado, but many customers mistake it for wholly guacamole.

On Wednesday, a Los Angeles woman sued the Northfield, Ill., food company, alleging that it committed fraud by calling its dip guacamole. Her lawyer says suits against other purveyors of "fake guacamole" will be filed soon.

The suit highlights the liberty some food companies take in labeling their products.

If consumers read the fine print, they would discover that Kraft Dips Guacamole contains less than 2 percent avocado. But few do. California avocado growers, who account for 95 percent of the U.S. avocado crop, said they didn't know that store-bought guacamole contains little of their produce.

"We have not looked at this issue, but we might follow it now that we are aware of it," said Tom Bellamore, the top lawyer at the California Avocado Commission.

Kraft and other food companies say that they don't deceive customers by skimping on the avocado. A spokeswoman for the company said most consumers understood that guacamole is part of the company's line of "flavored" dips.

"We think customers understand that it isn't made from avocado," said Claire Regan, Kraft Foods' vice president of corporate affairs. "All of the ingredients are listed on the label for consumers to reference."

Nonetheless, Kraft is relabeling the product.

Regan said the company is in the process of changing its label to make "clearer" that it is selling "guacamole flavor" dip. She said she was not familiar with the lawsuit.

Brenda Lifsey, the plaintiff, said she made a three-layer dip with Kraft guacamole last year only to discover that it contained almost none of the ingredient she most expected: avocado.

"It just didn't taste avocadoey," said Lifsey, who identified herself as a federal employee who lives in Los Angeles. "I looked at the ingredients and found there was almost no avocado in it."

In her suit against Kraft, Lifsey is asking the Los Angeles Superior Court to stop Kraft from marketing the dip as guacamole. She also wants attorneys' fees and unspecified punitive damages.

Unlike peanut butter, which by law must contain at least 90 percent peanuts, the U.S. Food and Drug Administration has no legal standard mandating how much avocado should be in guacamole. The FDA requires only that the labeling be truthful and not misleading, said Michael Herndon, an agency spokesman.

Like much of the prepared guacamole sold in supermarkets, Kraft guacamole is essentially a whipped paste made from partially hydrogenated soybean and coconut oils, corn syrup, whey, and food starch. Yellow and blue dyes give it the guacamole green color.

That's probably not what the Aztecs had in mind when they invented guacamole about 700 years ago. They made a sauce called ahuaca-mulli, which roughly translates to avocado mixture, according to the avocado commission. The dip was prepared by mashing avocados, sometimes with tomatoes and onions in a molcajete, a Mexican mortar and pestle.

The dip has become a U.S. tradition, especially on Super Bowl Sunday.

Ah, the good old American Justice System, eh?

Talk about a frivolous lawsuit that is a total waste of time and resources. That woman needs to get a life.

I think it's a good case really - why should multinational bastards like Kraft be allowed to sell stuff that is basically fake?

I agree m8, well except for the basically fake part due to it being 98% FAKE.


You don't buy a dog only to find out it's a parrot that smells like a dog without complaining about it when you realize.

If you read the ingredients it tells you there isn't any avacado in there. I've met other people who make it without avacado, especially when I come over become I'm allergic. The dip doesn't say that it contains it.

I can see her saying it needs to be relabled, which they are going to do. However, why should she get any money? She suffered no damages except for it not tasting "avacodoey" enough for her. If she wins it can open the flood gates for more people to make more frivolous lawsuits because don't taste the way they think it should.

I agree with you 100% Skylace. Why should the money grubbing cow get a thing! She's not suffered a damn bit, other than maybe being skint and wanting to make money off someone else the easy way.

She's a disgrace to herself as far as I'm concerned.

How many people actually read labels though? I do mostly, but I know that not many do - and it's that fact that these corporate bastards rely on when selling you a pig in a poke. The bigger issue here is that they are rip-off bastards and any fines levied might make them think twice about doing it in future.

Is that fair? What about to a short sighted person? Or someone who can't read or who can't read English and relies on the image of the avocado?

It's not their fault people don't read labels. That's why they have them so the information is there. It's not their fault the lady was too lazy to read it, and if she was that worried about it she should have.

As far as I'm concerned, anyone that sues over things like this are pathetic and trying to get rich by means of which they don't deserve. They also use the judicial system carelessly and cost the taxpayers money as well which isn't fair.

Why should everyone else have to pay for her ignorance and negligence in reading? I say eff her in the ear and I hope everyone she knows looks at her and calls her an arse.....because that's just what she is the bloody chancer Razz

she might well be a chancer, but is there public money involved? No lawyer would take a case like this on unless they thought they had a good chance of winning, and I'd guess it's one who's taken this on as a no-win no-fee.

The biggest rip off bastards on the planet are the corporate fat-cats, so anyone that takes a chunk of their cash is the lesser of two evils any day!

I could only possibly agree with you if the so called corporate fat-cats created a product that actually harmed someone. Suing a company for the sake of getting rich is totally wrong in my book.

When I hear stories like this, all I can think is the people are greedy bastards that want a free ride in life and would sell their soul to get it, and that's what this woman represents to me. She doesn't give a shit how much she's costing tax payers to go through the judicial system to get what she wants either, and I hope it all blows up in her greedy face thumbs
