Oh yeah, Luke, I forgot that one! It is loophole #37 "If a lie is repeated 20 times in public, then it becomes true" Who am I to go against the manual... Laughing What is that Eddie Izzard used to say, "It's 70% how you say something, 20% who you say it to and only 10% what you say" or something to that effect...

Quite a nice drawing you might think, but what's that funny smell? Oh, that'll be the genuine all-American bullshit it's painted with!

Probably one of the funniest legal documents you'll ever read. Thanks, Glenn Beck, for making sure that this rumour survives!

Glenn Beck Loses Domain Name Dispute
November 10, 2009
Andy Carvin
npr.org

Is the domain name glennbeckrapedandmurderedayounggirlin1990.com a violation of Glenn Beck's intellectual property? The conservative commenter certainly thought so, but an arbitration panel at the World Intellectual Property Organization has ruled otherwise. Last month we reported that Beck had filed a complaint with the World Intellectual Property Organization over a satire Web site with the provocative domain name glennbeckrapedandmurderedayounggirlin1990.com. The name is inspired by a Gilbert Gottfried comedy routine in which he praises fellow comedian Bob Saget, but then begs people to stop accusing Saget of raping and murdering a young girl in 1990. The Web site, developed by Isaac Eiland-Hall, applied the joke to Glenn Beck as a way to critique his rhetorical methods.

Beck's lawyers argued that because "Glenn Beck" is a registered trademark, Eiland-Hall's use of his name in the Web site's domain violated that trademark, and the URL was "confusingly similar" to it. They also argued that Eiland-Hall's Web site didn't constitute fair use because he "had not made sufficiently clear that it is intended to convey criticism through a form of comedy (i.e., that it is a 'joke')."

The WIPO ruling, released late last week, ruled against Glenn Beck. It dismissed Beck's argument that Internet users could be confused by the domain name and its accompanying Web site. "Even a 'moron in a hurry,'" read the decision, quoting Eiland-Hall's attorney, "would not likely conclude that Complainant sponsored, endorsed or was affiliated with the website addressed by the disputed domain name."

Regarding Beck's argument that the domain name was defamatory, the arbitration ruling effectively punted. They acknowledged that the domain name in itself is "unflattering, pejorative and inflammatory," and said a court would be better suited to consider whether it was actually defamatory. Beck's lawyers did not immediately respond to a request from us for comment on the ruling.

Normally, this might have been the end of the matter. After winning the dispute, though, Eiland-Hall published a scathing open letter to Beck:

It bears observing that by bringing the WIPO complaint, you took what was merely one small critique meme, in a sea of internet memes, and turned it into a super-meme. Then, in pressing forward (by not withdrawing the complaint and instead filing additional briefs), you turned the super-meme into an object lesson in First Amendment principles.

It also bears noting, in this matter and for the future, that you are entirely in control of whether or not you are the subject of this kind of criticism. I chose to criticize you using the well-tested method of satire because of its effectiveness. But, humor aside, your rhetorical style is no laughing matter. In this context of the WIPO case, you denigrated the letter of First Amendment law. In the context of your television show and your notoriety, you routinely and shamelessly denigrate the spirit of the First Amendment. The purpose of the expressive freedoms embodied in the First Amendment is not to simply permit the greatest possible scope of expression, but also, in doing so, to also strive for excellence in the conveyance of ideas. Rather than choosing to strive for excellence and civic contribution, you simply pander to the fears and insecurities of your audience. And in the process, you do them, and all of us, a great deal of harm.

Shame on you Mr. Beck.

Perhaps most surprisingly, though, Eiland-Hall stated that he no longer needed the domain name in question, now that he's successfully argued the right to own it. "I have no more use for the actual scrap of digital real estate you sought," he wrote. With that, he offers to turn over the domain to Beck, even supplying the user name and password to access it.

Does that mean the Web site that started this whole kerfuffle is gone forever? Hardly. Eiland-Hall has moved it to a new domain, gb1990.net. At the time of writing, the original domain is still up and running was up and running, but has apparently just been shut down as of 3:15pm today. Another version of the domain, didglennbeckrapeandmurderayounggirlin1990.com, is still working, but that may be temporary as well. Anyone taking bets on what Glenn Beck will put in its place?

2010-03-10

I know this guy Glenn Beck is a dick but I can’t stop watching his tv show these days. I’m not proud that I can’t kick the habit. I do think I’ve figured out why this is happening though and it may be the reason other people keep watching his crappy program too. It’s the blackboard. I really think it is. Something deep down inside me, deeper than my gall bladder or intestines is saying that it’s pretty neat. The blackboard, not the dumb shit with the sorta crew cut. Maybe my mind is saying enough with those high tech toys that most shows use, remember your glory years in grade school where you were kinda smart (it’s really tough for anyone to think you’re dumb in like the 4th grade). In those days it was pretty easy to remember stuff the teacher wrote down with your basic white chalk. Some days they used yellow but that was mostly for important stuff like when it was Dr. Seuss’s birthday or early dismissal.

It really messes with my head when I know most of the stuff he says is pulled out of his ass but it still sorta seeps into my brain and I’m kinda worried what it’s is doing in there. Will it come spewing out at a bad time? Like if I’m at a black friends house hanging out and all of a sudden I start dropping a rant about Van Jones or Rev Wright will I piss them off? It’s been on my mind lately, where does all this information go? I figure if I watch like 2 or 3 of Glenn Beck shows a week there’s a ton of gunk swirling inside me and it’s got to go somewhere. Maybe I will pee it away but I doubt it. It could be inside me forever and that’s scary man.

One night last week I couldn’t sleep cuz I kept seeing that chalk board and all those words like “Communist” “Socialist” “Nazi” “Progressive” “Social Justice” “Stalin” “Welfare State” “Auto Erotic-Asphyxia”(ahhh maybe that last one was from TMZ). Anyway, the point is Glenn Beck is wrecking my mind and I don’t like it. I just wish he would stop going old school and try one of those thingy’s John Madden uses on football games. You know where he writes those squiggles and drunk fans at home scream at the tv cuz they already know what a play action pass or a zone blocking scheme is so why is he messing up the screen? If Beck used one of those his garbage would be in one ear and out the other. I could watch his show 24/7 and there would be no harm no foul but I’m thinking there’s no way he’s gonna ditch the chalkboard any time soon.

I guess he’s more popular now on FOX NEWS than that chubby ex frat boy Hannity or O’Reilly so we might as well get used to him being in our face for at least 2 or 3 more years. I figure about 2013 or so he will flame out with a bust on some sex deal and then try and make a comeback later on one of VH1’s rehab programs. He reminds me of Jason except as far as I know he doesn’t kill everyone around him with his own hands. No, he does it slowly by getting millions of people to watch his tv program and listen to his radio show and then their internal organs start to shut down. It’s not pretty. Have you seen what those Tea Baggers on the news look like? Try Dawn of The Dead but with only white people. At least George Romero would throw in a couple black or Puerto Rican zombies. His movies looked like America but Beck’s show looks like a Curling match on the CBC. Don’t he and all his jealous bro’s on Fox News know that they’ll soon be kissing the ass of people that don’t look like them? It’ll be like the Alamo and remember it didn’t end real well for the team that bought into that “manifest destiny” scam.

The thing about him saying Obama is trying to turn this country into a commie crash pad for lazy slobs just doesn’t make sense to me and yesterday he wrote with his own hands that the Prez wants all of the terrorists in that sandy part of the world to come and visit the USA. I had never heard this one before but I guess he wants them to see that we have so much neat stuff here and hopes they won’t wanna blow it up. It’s hard to believe like most of Beck’s stuff but what if he’s on the money on this one? Or what if Obamacare does mean the End of Days are here. That would be a real bummer. I mean I could deal with it and everything cuz I owe a shitload of money on a bunch of credit cards but if we all go now no one would ever get to see if the Who ever retire for good or what Jennifer Anniston would look like at 65 or if Toyota ever fixed their death cars. It’s not the best time for the world to close up shop if you ask me so I really, really hope that Glenn Beck is full of it and nothing he writes down on his chalk board comes true. Ok, except the one about Progressives baking pot brownies and giving them away free at malls everywhere. That would be kinda cool. Maybe once or twice a year. Later.

Glenn Beck 'to transition off' Fox News
Network axes Tea Party icon's daily slot amid mounting controversies and exodus of advertisers

Sagging ratings, a string of damaging remarks and an exodus of advertisers have combined to end Glenn Beck's controversial tenure on US cable network Fox News.

The news follows weeks of speculation about Beck's future, as a campaign to pressure advertisers to boycott the pundit's daily 5pm slot gathered pace, while Beck himself was embroiled in battles erupting from his often rococo conspiracy theories involving the likes of George Soros and Barack Obama.

An elliptical statement by Beck's production company and Fox News said: "Glenn intends to transition off of his daily programme, the third highest rated in all of cable news, later this year."

But the statement also put a face-saving spin on the decision to end Beck's show, quoting Fox News's chief executive Roger Ailes: "Glenn Beck is a powerful communicator, a creative entrepreneur and a true success by anybody's standards. I look forward to continuing to work with him."

The joint statement mentioned unnamed future "television projects for air on the Fox News Channel as well as content for other platforms", without giving any detail. Beck himself wasn't burning any bridges, saying in his statement: "I truly believe that America owes a lot to Roger Ailes and Fox News."

The Glenn Beck show has been broadcast each weekday on Fox News since December 2009, when Beck moved to the network after an ill-fated show on CNN's Headline News channel. His current contract was due to expire in December this year. The announcement was greeted with joy among Beck's phalanx of critics on the left.

David Brock of Media Matters for America, one of Beck's most vociferous critics, said: "After losing more than 300 advertisers and seeing more than a million viewers abandon his show, the only surprise is that it took Fox News months to reach this decision."

The StopBeck campaign, designed to lobby corporations against advertising on Beck's show, welcomed the news with a simple Twitter posting: "VICTORY!"

The show's peak of popularity coincided with the rise of the Tea Party, and his trademark blend of paranoia and conspiracy attracting a wide following – and an equally wide circle of criticism, thanks to often bizarre statements.

Beck's string of eyebrow-raising claims on air includes his 2009 description of Obama as "a guy who has a deep-seated hatred for white people or the white culture... This guy is, I believe, a racist."

More recently, Beck held a two-day "investigation" into George Soros, who funds a variety of liberal causes in the US. Beck's denunciation included reference to Soros's wartime childhood in Hungary, with Beck claiming: "Here's a Jewish boy helping send the Jews to the death camps." Beck's remarks were decried as "monstrous" by Jewish groups.

Beck's audience has shrunk from a peak of around 2.9 million viewers at the start of 2010 to less than 1.8m, according to recent ratings. On Fox that left Beck lagging far behind the channel's primetime stars, Bill O'Reilly and Sean Hannity.

As the audience dried up, so did the advertising. The list of high profile advertisers avoiding his show has grown, and now includes household names such as Coca-Cola, American Express, AT&T and Nestlé. In the UK, where Beck's show is carried by the Fox News international channel, advertisers are so scarce that the network fills the ad breaks with silent Sky News updates.
